Liability Waiver
1. Acknowledgement of Risk
I acknowledge that participation in a road cycling holiday organised by Borne Group SARL (“the Company”) involves inherent risks, including but not limited to:
Accidents, collisions, or falls while cycling;
Weather changes, road surface conditions, and natural hazards;
Traffic and interaction with vehicles or pedestrians;
Equipment failure or mechanical issues;
Physical exertion, dehydration, illness, or injury;
Risks related to travel in mountainous or unfamiliar regions.
I understand that these risks cannot be entirely eliminated, even with appropriate care and supervision, and I voluntarily accept all such risks.
2. Participant Responsibilities
I confirm that:
I am in good physical and mental health and capable of participating in the trip’s activities.
I will comply with all Swiss road traffic regulations, safety instructions, and guidance provided by the Company’s staff.
I will wear a certified cycling helmet and appropriate protective equipment at all times while cycling.
My bicycle and equipment are in safe working condition.
I have informed the Company of any relevant medical conditions, medications, or allergies that may affect my participation.
3. Release of Liability
To the fullest extent permitted under Swiss law, I hereby waive and release the Company, its owners, employees, guides, agents, and contractors from any liability for loss, damage, injury, or death arising from participation in any cycling activity organised by the Company, whether caused by ordinary negligence or otherwise.
This waiver does not exclude or limit liability of the Company or its representatives for:
Intentional wrongdoing or gross negligence (Art. 100 Swiss Code of Obligations);
Personal injury or death caused by such negligence; or
Any mandatory liability under applicable Swiss law (e.g., under the Swiss Product Liability Act).
4. Insurance
I confirm that I have obtained adequate personal insurance covering:
Medical expenses and emergency evacuation;
Personal accident and liability related to cycling activities; and
Repatriation in the event of serious injury or death.
I understand that the Company’s insurance does not cover personal loss, injury, or damage to equipment unless explicitly stated in writing.
5. Governing Law and Jurisdiction
This agreement shall be governed by and construed in accordance with Swiss law. Any dispute arising out of or in connection with this agreement shall be subject to the exclusive jurisdiction of the competent courts of Geneva, Switzerland.
